References to "we", "us", or "our" in these terms refer to NearestPlane Limited. References to "you" or "your" refer to the customer or user.
You must be at least 18 years of age to purchase from NearestPlane. By placing an order, you confirm that you meet this requirement. If you are purchasing on behalf of a business, you confirm that you have authority to bind that business to these terms.
NearestPlane is a WiFi-connected LED matrix display that shows information about nearby aircraft using publicly available ADS-B data. The device requires a working WiFi connection and a suitable power supply (USB-C, 5V) to operate.
The device is intended for personal, informational, and recreational use only. It is not intended for use in aviation, navigation, safety-critical applications, or any environment where the accuracy or availability of flight data is relied upon.
All orders are subject to acceptance and availability. Placing an order does not constitute a binding contract until we confirm acceptance. We reserve the right to refuse or cancel any order at our discretion, in which case a full refund will be issued promptly.
Prices are shown in pounds sterling (GBP) and are inclusive of VAT where applicable. Payment is processed securely by Stripe — we do not store, handle, or have access to your card details at any point. Stripe's own privacy policy and terms govern the processing of your payment information.
For international orders, currency conversion and any bank charges are the responsibility of the customer.
Each NearestPlane device is handmade to order. We aim to dispatch as quickly as possible, but during busy periods dispatch may take up to 14 days. You will receive a shipping confirmation email with a tracking number as soon as your order has been dispatched.
Delivery timescales once dispatched are dependent on Royal Mail and are outside our control. We are not liable for delays caused by the postal service, customs, or other circumstances beyond our reasonable control.
International customers may be subject to local customs duties, import taxes, or handling fees. These are the responsibility of the recipient and are not refundable by us under any circumstances.
All firmware, software, server-side code, website content, branding, and design associated with NearestPlane are the intellectual property of NearestPlane Limited and are protected by copyright and other applicable laws.
The firmware loaded onto your device is licensed to you for personal use on the device you purchased. You may not copy, redistribute, reverse engineer, decompile, or modify the firmware or any other NearestPlane software without our express written permission.
Over-the-air (OTA) firmware updates are delivered remotely to keep your device running correctly. By enabling remote management, you agree to receive these updates. We will never use OTA to deliver harmful, malicious, or unauthorised changes to your device.

Our total liability to you in connection with any order shall not exceed the amount you paid for that order. Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
NearestPlane relies on a number of third-party services to function, including flight data providers, route data services, and Stripe for payments. We are not responsible for the availability, accuracy, or conduct of these services. Each third-party service is subject to its own terms and privacy policy.
We reserve the right to modify, suspend, or discontinue any aspect of the NearestPlane service (including the server-side infrastructure, data sources, and OTA update system) at any time. We will always endeavour to give reasonable notice of significant changes. Your device will continue to function using locally cached data even if server connectivity is lost, though route lookups and remote management will be unavailable.
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in another part of the United Kingdom, you may also have rights under the applicable law of that jurisdiction.
Nothing in these terms affects your statutory rights under UK consumer law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. These rights are in addition to, and not instead of, any rights we offer in our returns and warranty policy below.

Our website uses Google Analytics and Meta Pixel (Facebook) for aggregate traffic analysis and advertising measurement. These tools may set cookies on your device. We also use Reddit's advertising pixel for the same purpose.
These tools collect anonymised information about how visitors use our website. They do not collect your name or contact details. You can opt out of Google Analytics via Google's opt-out tool.

We take reasonable technical and organisational measures to protect the data we hold. Our server infrastructure uses HTTPS encryption for all data in transit. Access to the device management system is protected by multi-factor authentication. We do not store payment card data at any point.
No system is completely secure. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify the ICO within 72 hours and inform affected individuals as required by UK GDPR.
We may update this Privacy Policy from time to time. The date at the top of this section indicates when it was last revised. Continued use of your device or our website following any changes constitutes acceptance of the updated policy.

You have 14 days from the date of delivery to return your NearestPlane for a full refund. The device must be returned in its original condition and packaging.

Refunds are processed within 5 business days of receiving the returned item, to the original payment method.
Every NearestPlane is covered by a warranty against manufacturing defects and hardware faults, starting from the date of delivery.

For warranty claims, please contact us first — we will always try to resolve issues remotely before asking you to post anything back.
All NearestPlane devices come with lifetime support from the person who built them. There are no bots, no ticket queues, and no expiry date. We will always do everything we reasonably can to help you get your device working — regardless of when you bought it.
Support includes: setup assistance, troubleshooting, remote firmware updates, settings changes, and general advice. Many issues are resolved remotely within hours without any need to post anything.
International customers have the same 14-day return window, but a 3-month warranty. Return postage for warranty claims and change-of-mind returns is the customer's responsibility. Customs duties and import taxes are not refundable by us.
Nothing in this policy affects your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013. UK customers are entitled to goods of satisfactory quality, fit for purpose, and as described. Faults arising within 30 days of delivery entitle you to a full refund at your option.
